This website is owned and operated by Black Smoke Threads LLC (“Black Smoke Threads,” “BST,” “we,” “us,” or “our”). By accessing this website, purchasing our products, or using our services, you acknowledge and agree to the terms outlined in this Legal Notice.
PRODUCT INFORMATION & HANDCRAFTED GOODS
Black Smoke Threads specializes in handcrafted and custom leather goods. Because genuine leather is a natural material and many of our products are made by hand, variations in color, grain, texture, markings, tooling, stitching, and finish are normal and are not considered defects.
We make reasonable efforts to accurately display and describe our products. However, photographs, screen displays, leather batches, dye lots, and other factors may cause the finished product to vary slightly from images shown online or previously produced items.
CUSTOM ORDERS
Customers are responsible for reviewing and approving all submitted names, numbers, spelling, sizing, colors, designs, and other customization details before production.
Black Smoke Threads is not responsible for errors resulting from information provided or approved by the customer. Once production has begun, custom or personalized orders generally cannot be changed, canceled, returned, or refunded except where required by applicable law or where Black Smoke Threads determines that the product contains a manufacturing defect.
FIREFIGHTER & WORK-RELATED PRODUCTS
Certain Black Smoke Threads products may be designed in styles commonly used by firefighters, first responders, tradespeople, or other professionals.
Unless a product is specifically identified in writing by Black Smoke Threads as certified safety equipment, Black Smoke Threads products are not certified personal protective equipment (PPE), fall-protection equipment, Class I/II/III safety harnesses, rescue equipment, or life-safety devices.
Truck belts, leather belts, suspenders, straps, hardware, and similar products are not intended to support a person’s body weight, arrest a fall, facilitate rescue, or replace equipment required by an employer, department, manufacturer, regulatory agency, or applicable safety standard.
Customers are responsible for determining whether a product is appropriate for their intended use and for complying with their department, employer, workplace, and applicable safety requirements.
PRODUCT USE & INSPECTION
Leather, stitching, webbing, hardware, fasteners, and other components can wear or deteriorate with time and use. Products should be inspected regularly and discontinued from use if they show excessive wear, damage, cracking, loose stitching, compromised hardware, or other conditions that could affect their performance.
Customers assume responsibility for the proper use, care, maintenance, and inspection of purchased products.
To the fullest extent permitted by applicable law, Black Smoke Threads is not responsible for injury, property damage, loss, or other damages resulting from misuse, modification, improper maintenance, use contrary to provided instructions or warnings, or use of a product for a purpose for which it was not designed.
INTELLECTUAL PROPERTY
Unless otherwise stated, all Black Smoke Threads branding, logos, product photographs, graphics, artwork, original designs, website content, written materials, and other original content are owned by or licensed to Black Smoke Threads and are protected by applicable intellectual property laws.
Black Smoke Threads content may not be copied, reproduced, distributed, sold, modified, or used for commercial purposes without prior written permission.
Customer-provided logos, department insignia, trademarks, artwork, or other protected materials remain the property of their respective owners. By submitting such material for a custom order, the customer represents that they have the necessary authorization or rights to request its reproduction. Black Smoke Threads does not claim ownership of third-party trademarks reproduced at a customer’s request.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Black Smoke Threads LLC and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the purchase, possession, use, or misuse of our products or use of this website.
Nothing in this Legal Notice is intended to waive or limit any rights or remedies that cannot legally be waived or limited under applicable law.
